Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using the Magic Friends mobile application (the “App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and MFCIUS L.L.C. (“Company,” “we,” “our,” or “us”).

2. Description of Service

Magic Friends is an AI-powered educational platform designed for children aged 4–10. The App provides:

• Interactive gameplay including challenges, quizzes, puzzles, and creative tasks
• Educational modules enhancing problem-solving, creativity, and life skills
• Virtual AI-powered companions for engaging learning experiences
• Parental controls for monitoring and managing children’s activities
• A safe environment adhering to strict child-safety guidelines

3. Parental Consent and COPPA Compliance

The App is intended for use by children aged 4–10 under the supervision of a parent or legal guardian. By allowing your child to use the App, you represent that you:

• Are the parent or legal guardian of that child
• Consent to their use of the App in accordance with these Terms
• Are responsible for monitoring your child’s activities within the App
• Authorize any purchases made through your authenticated account

We comply with the Children’s Online Privacy Protection Act (COPPA). Only parents/guardians can create accounts, and child profiles are stored locally on the device only.

4. User Accounts and Authentication

To access premium features and manage subscriptions, parents/guardians must create an account. We offer the following authentication methods:

• Email and password registration
• Sign in with Apple
• Sign in with Google

Account Requirements

• You must provide accurate and complete information during registration
• You must use a strong, secure password and keep it confidential
• Children are not permitted to create or manage accounts
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity. You may request deletion of your account at any time — see our account deletion page.

5. Subscriptions

Magic Friends offers optional premium subscription plans:

• Premium Membership Weekly: $4.99/week
• Premium Membership Monthly: $2.99/month
• Premium Membership Yearly: $24.99/year

Subscription Terms

• All subscriptions are billed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store or Google Play account settings
• Apple and Google’s respective terms and conditions govern all payment processing

6. In-App Purchases and Digital Assets

Parents can purchase digital assets generated within the app:

• Card Set: $14.99 — Personalized cards featuring AI-generated content created by your child
• Additional digital assets may be offered within the app

Purchase Terms

• All purchases require authentication through a parent/guardian account
• Device-level protections (Face ID, Touch ID, password) provide additional purchase authorization through Apple and Google
• Digital assets are non-transferable and licensed for personal use only
• Purchased content is linked to your account and cannot be transferred to other accounts
• We are not responsible for purchases made by children who gain unauthorized access to a parent’s device or account

7. Refund Policy

Refund requests for subscriptions and in-app purchases are handled directly by Apple or Google, depending on where you made the purchase:

• Apple App Store: Contact Apple Support or request a refund through reportaproblem.apple.com
• Google Play Store: Contact Google Play Support or request a refund through your Google Play purchase history

We do not process refunds directly. All refund decisions are made by Apple or Google according to their respective policies.

8. User Conduct

When using the App, you agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App or servers
• Reverse engineer, decompile, or disassemble the App
• Use the App in any way that could harm children
• Share your account credentials with others
• Create multiple accounts to abuse free trials or promotions

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of MFCIUS L.L.C. and are protected by international copyright, trademark, and other intellectual property laws.

10. AI-Generated Content and Purchasable Assets

The App uses artificial intelligence to generate content, including virtual companions, educational materials, and purchasable digital assets:

• AI-generated content is created based on interactions within the App
• While we implement safety measures, AI content may occasionally produce unexpected results
• Parents are encouraged to monitor their children’s interactions
• Purchasable assets (such as card sets) feature content generated through your child’s interactions
• We reserve the right to review and moderate content before it is made available for purchase

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MFCIUS L.L.C. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Unauthorized purchases made by children
• Loss of data or digital assets
• Service interruptions or unavailability
• Any issues arising from third-party payment processors (Apple/Google)

13. Indemnification

You agree to indemnify and hold harmless MFCIUS L.L.C. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App, violation of these Terms, or failure to properly secure your account credentials.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
